Uncharted is an exploration community that provides an easy and fun way to share original content (photos and writing) of your travel adventures with others from around the world. While viewing content on Uncharted is open to everyone, you must be a registered explorer to share your own adventures, post comments, participate in discussions, and connect with other explorers.

We want to provide a safe place where people of diverse backgrounds, cultures, and locations can share and interact with each other and our staff. Mutual respect and understanding are at the heart of our community. By signing up for Uncharted, sharing content, viewing content, posting comments, and participating in any other way, you agree to the Terms and Conditions of Use, the Privacy Policy, and to follow Uncharted’s Community Guidelines as follows: 

Respect Others – We’re a worldwide movement made up of many different people, cultures, religions and political affiliations. The purpose of Uncharted is to explore the world together, sharing useful content that helps others have a better travel experience, learn about new cultures, meet interesting people, and experience new places. While discussion and differing perspectives are encouraged on Uncharted, conduct your communication with respect and courtesy.

 Age Requirement – You must be at least 14 years or older to use Uncharted. If you are under 18 years of age, you must have the permission of your parent or guardian. By agreeing to these guidelines you certify that you have obtained the necessary permission to be registered on the site. Original Content – Only share content that you created. Don’t steal photos or writing that others have created and use it as your own. If it’s not yours, don’t upload it. Get permission to link to it, or, even better, invite the content owner to become an explorer on Uncharted so they can share it with everyone. Do not sell another person’s content. Do not create or transmit unwanted “spam” to any person. You are welcome to link to Uncharted content from your personal website or blog, but you should not publish content on your website or blog without the express written permission of the copyright owner. This includes downloading low resolution images and displaying them on your personal website or blog. You should always contact the copyright owner and obtain permission before using content that is not your own, even if no copyright is displayed. 

Copyright Ownership – Your content will keep whatever copyright it had before you shared it on Uncharted. By submitting content to the website, you are granting Uncharted a non-exclusive license to use, distribute, reproduce, modify, adapt, and display it for promotional purposes. Notwithstanding this agreement, we generally make effort to contact you before using your content for promotional purposes. We will never sell your content to a third party without your consent. Uncharted is under no obligation, unless otherwise specified in written agreement between Uncharted and the user, to pay a user for using their content for promotional purposes. 

No Discrimination – We don’t discriminate. Becoming an Explorer on Uncharted is a great opportunity to learn from others and gain appreciation for people and places that are unfamiliar to us. Show respect in your interactions with everyone. Racist, discriminatory, disrespectful, demeaning, threatening, and predatory conduct will not be tolerated. 

No Nudity/Pornographic Content – Keep your content family friendly. Do not publish, share, display, or promote content that contains nudity or is considered pornographic, offensive, profane, or obscene. It will be removed immediately without exception and your account will be deleted. Uncharted reserves the right to evaluate all content for appropriateness and to remove it for any reason, without prior notice, as it sees fit. In the case of any criminal activity, we will report you to the appropriate authorities. Illegal

Content/Activity – Don’t share content that is illegal, prohibitive, or violates a person’s privacy. Do not post content that is false, inaccurate, libelous, defamatory, abusive, or that infringes on any copyright or other right of any person. Using Uncharted to share about or conduct any illegal or criminal activity will result in having your account deleted and you will be reported to the appropriate authorities. No Harassment – Don’t stalk, harass, annoy, intimidate, impersonate, or do harm to any person. If we get a valid complaint about your conduct, your account could be deleted and, if necessary, you will be reported to the appropriate authorities. Safety First – Be careful about interacting with people online. Don’t meet up with people you have never met without taking some safety precautions. We encourage you to meet new people in public locations with at least one other person present or as part of a group. Be careful about giving your private information to other users. Never give your username and password to anyone. Report any concerns or potential threats to the authorities and notify Uncharted’s staff. If you are under 18, include your parents or guardians in any online communications and make sure at least one parent or guardian accompanies you to meet anyone in person. Do not post or transmit, or cause to be posted or transmitted, any communication or solicitation designed to obtain password, account, or private information from other users. 

No Inappropriate Language – Offensive, foul, derogatory, racist, discriminatory, disrespectful language will not be tolerated on Uncharted and will be promptly removed from the site. Users who continue using inappropriate language after being warned may have their accounts deleted. 

No Unauthorized Commercial Activity – If you’re a business owner, employee, or other representative and you want to promote your venture and its related products or services on Uncharted, you need to be an approved sponsor. If we find you are using Uncharted to engage in any unauthorized commercial activity, we’ll give you a warning and ask you to apply to become an official sponsor or advertiser. If you continue to conduct unauthorized commercial activity after being warned, your account will be deleted. Contact our team about affordable sponsorship opportunities to promote your business, products, services, and events. Uncharted reserves the right to approve or reject sponsorship and advertising applications as it sees fit. Uncharted strives to provide an appropriate place for promotions and advertisements useful to our users that will not get in the way of explorers sharing their content and interacting with each other. This is why we only allow approved sponsors to use our services for commercial purposes. 

Dealing with Offensive or Inappropriate Content – If you are offended by any content, you can either ignore it by clicking away, or you can click the flag button at the top of each page. This will automatically make the content in question disappear from your view and at the same time alert Uncharted Staff about the issue. While this action will remove the offensive content from your view, others will still be able to see it. Please provide as much detail about the offensive content as possible so we can quickly investigate the situation, resolve the issue, have the offensive content removed from the site, and prevent similar incidents from taking place in the future. 

Dealing with Copyright Infringement – If you see content that you’ve created being used by another explorer, first contact the user directly and see if you can resolve the issue yourself. Chances are it is a misunderstanding that can be easily resolved. If this doesn’t work, contact our staff directly. Provide as much information as possible about the infraction and why you think it should be investigated. We will look into the issue as soon as possible. If the user is found in violation of copyright infringement, the content will be removed as soon as possible and their account will be terminated. While we will make every effort to have the content in question removed as soon as possible, you are solely responsible for your interactions with other users on Uncharted. Uncharted reserves the right, but has no obligation, to monitor and mediate disputes between you and other users. 

Policy Changes

Changes to the Uncharted Community Guidelines Uncharted may revise or amend these community guidelines, its Terms and Conditions of Use, and its Privacy Policy at its own discretion and at any time without notice. Use of information we collect is subject to the policy in effect at the time it was used. By using this website, you are agreeing to be bound by the then current version of these Terms and Conditions of Use, the Privacy Policy, and the Uncharted Community Guidelines. Uncharted shall make reasonable effort to notify users of any substantive changes to these policies. Reasonable effort is considered sending an e-mail notification to users at the e-mail address stored on a user’s account at least one week prior to implementing any policy changes. Users who do not have a current, active e-mail address stored on their accounts are subject to any policy changes made. Uncharted’s goal is to make sure its users clearly understand how their personal information submitted via its website services is being collected, managed, and disclosed. Agreement Date This agreement is effective June 1, 2014.

Acceptance of Terms Please read these terms carefully before using our services. By accessing this site, viewing any content, or using any services available through the site, you are agreeing to be bound by these Terms and Conditions, our Privacy Policy, the Uncharted Community Guidelines, and all applicable laws and regulations.

If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained on this site are protected by applicable copyright and trademark law. 

Description of Service 

Uncharted is an online exploration community that provides an easy and fun way to share original content (photos and writing) of your travel adventures with others from around the world. Content includes, but is not limited to text, comments, photographs, video, illustrations, and articles. Users can use Uncharted’s website to share about their adventures, link up with other users, and participate in discussions, educational programs, and events.

Uncharted may offer additional services in the future. These services are also subject to the terms of this agreement. Your access to and use of the site may be interrupted at times because of equipment malfunction, updating, maintenance or repairs, natural disasters, power outages, and other events beyond the control of Uncharted.

Uncharted reserves the right to suspend or discontinue the availability of the website, its services, and content at any time at its own discretion and without prior notice. The site should not be relied upon as the sole storage space for your content.

Use License Permission is granted to temporarily download one copy of the materials (information or software) on Uncharted’s website for personal, noncommercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  1. modify or copy materials;
  2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  3. attempt to decompile or reverse engineer any software contained on Uncharted’s website;
  4. remove any copyright or other proprietary notations from the materials; or
  5. transfer the materials to another person or “mirror” the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Uncharted at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. 

Disclaimer 

The materials on Uncharted’s website are provided “as is.” Uncharted makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further,

Uncharted does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the material on its Internet website or otherwise relating to such materials or on any sites linked to this site. Limitations In no event shall Uncharted or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Uncharted’s website, even if Uncharted or an authorized Uncharted representative has been notified orally or in writing of the possibility of such damage.

Because some jurisdictions do not allow limitations or implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you. 

Revisions and Errors 

The materials appearing on Uncharted’s website could include technical, typographical, mapping or photographic errors. Uncharted does not warrant that any of the materials on its website are accurate, complete, or current. Uncharted may make changes to the materials contained on its website at any time without notice. Uncharted does not, however, make any commitment to update the materials.

Uncharted is not responsible for errors or inaccurate content made by its users or errors found in third-party mapping services provided by Google. Registration Required As a condition to using Uncharted, you are required to register as an explorer, generate a password, and provide registration information.

The information you provide must be accurate, complete, and current at all times. Your account must be associated with a current, active e-mail address. Failure to comply with these requirements constitutes a breach of this agreement, which may result in the termination of your account.

You may not use a screen name that is the name of another person or entity or that is not lawfully available for use, or that is otherwise offensive, vulgar or obscene. You are responsible for maintaining the confidentiality of your password and for all activities resulting from the use of your password and conducted through your explorer account.

These services are for individuals and are not to be used for commercial purposes. Only approved Uncharted sponsors may use the website for commercial purposes. If you do not qualify for registration, you are not permitted to open an account or use the services. 

User Conduct 

Users agree to the Uncharted Community Guidelines, the Terms and Conditions of Use, and the Privacy Policy. All content posted or otherwise submitted is the sole responsibility of the account holder from which such content originates.

You acknowledge and agree that you, not Uncharted, are entirely responsible for all content that you post or otherwise submit to the website. You also understand that by using the site you may be exposed to content that is offensive, indecent, or objectionable.

As a condition of use, you promise not to use the services for any purpose which is unlawful or prohibited by these terms, or any other purpose not reasonably intended by Uncharted. 

Copyright Ownership 

Your content will keep whatever copyright it had before you shared it on Uncharted. By submitting content to the website you represent that you are the copyright owner and you have the full and complete right to enter into this agreement. You also affirm that the content does not defame any persons and does not infringe on the copyright, privacy rights, and any other right of any person and does not violate any law. By submitting content to the website, you are granting

Uncharted a non-exclusive license to use the content for promotional purposes and to distribute, reproduce, modify, adapt, and display it. Uncharted will never sell your content without your consent.

Uncharted cannot guarantee that users or outside parties will not unlawfully copy or use your copyrighted content. Users who infringe on copyright are subject to removal from Uncharted as stated in the Uncharted Community Guidelines

Trademarks 

Uncharted is a registered trademark and may not be used in connection with any product or service without the prior written consent of Uncharted. The images and icons available may be used by approved third party sponsors and sites in connection with providing appropriate links and advertising to the Uncharted website. 

Links 

Uncharted has not reviewed all websites linked to its site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Uncharted of the site. Use of any such linked website is at the user’s own risk. Terms and Conditions of Use Changes Uncharted may revise or amend these Terms and Conditions of Use, its Privacy Policy, and the Uncharted Community Guidelines at its own discretion and at any time without notice.

Paid Services 

Uncharted offers enhanced services for users who pay an annual subscription. In addition to the general terms and conditions of use, the following terms and conditions apply specifically to subscribers: Subscription services are described on the Upgrade Account section. Any feature not described in the Upgrade Account section does not qualify for a refund.

Uncharted may modify, suspend, or discontinue services provided to subscribers at any time at its own discretion and without prior notice.

Your credit card will automatically be charged the current fee for the service you choose on the date that you make your purchase. If you do not cancel your Uncharted subscription by the end of the current term, your credit card on file will also be charged the then-current fee for that service at the commencement of each renewal term.

If your credit card is invalid for any reason, your Uncharted subscription will revert to a free account and will be subject to the limitations of a free account. Fees may not be credited towards other services. If you cancel your subscription, your account will revert to a free account and will be subject to the limitations of free accounts.

Unless Uncharted provides notice otherwise, payment for the service is non-refundable. All currency references are in U.S. dollars. Termination Uncharted may terminate or suspend any and all services and accounts immediately, without prior notice or liability, for any reason whatsoever, including the breach of these terms.

Upon termination, your right to use the services will cease. If your termination is the result of the violation of these terms, you will not be eligible, without the express written permission of Uncharted, to create a new account.

Users who have paid for a subscription and are found to be in violation of these terms will not be eligible for a refund. You may terminate your Uncharted account at any time. Upon deleting your account, all information, content, and other data will be deleted and your agreement with Uncharted is terminated.

You may create a new Uncharted account at any time.

Indemnity

You agree to indemnify and hold harmless, Uncharted, its affiliates, subsidiaries, officers, owners, agents, employees, and other partners, from any claim or demand, including reasonable attorney’s fees, made by a third party due to or arising out of your use of and access to Uncharted, your violation of the Terms and Conditions of Use, the Privacy Policy, the Uncharted Community Guidelines, your violation of any rights of another person or entity, or your violation of any applicable laws or regulations. 

Governing Law 

Any claim relating to Uncharted’s website shall be governed by and interpreted in accordance with the laws of the State of Utah (without regard to principles of conflicts of law). Severability 

If any term or provision of these Terms and Conditions of Use is held to be void or unenforceable, that term or provision will be severed from this agreement, the balance of the agreement will survive, and the balance of this agreement will be reasonably construed to carry out the intent of the parties as evidenced by the terms of this agreement. Agreement Date This agreement is effective June 1, 2014.

Privacy Policy

Uncharted was founded to help people explore the world and share about their adventures with others. We take your privacy very seriously and care about how your personal information is used, shared, and managed. When you visit Uncharted, you accept the practices outlined in this Privacy Policy, the Terms and Conditions of Use, and the Uncharted Community Guidelines. This policy covers how Uncharted collects and uses your personal information. The policy does not apply to the practices of third parties that Uncharted does not own or control, or of individuals that Uncharted does not employ or manage. Here’s the Information We Collect We only collect information relevant to help us provide you with the best user experience possible. To use Uncharted, we require personal information such as your name (first and last), city, state/province, country, a screen name, and an active e-mail address. To help you share more about yourself and interact with other explorers, you may choose to provide additional information, such as your favorite places, a short bio, favorite foods, and your personal website. You might also upload a profile photo. Information that is marked “private” will not be displayed to the public or Uncharted users, either on your “My World” page or on any maps. Since Uncharted is about sharing adventures, all content, user profile information not marked as “private,” profile photos, and maps are viewable to the public. Content and user profiles are displayed on all Uncharted maps. In the interest of your personal safety, we do not display your exact address on your profile or your profile map and only registered users can view your “My World” page. Again, any information marked as “private” will not be displayed to the public. You should exercise caution when displaying your personal website on your profile or when providing your address or other private information to other users. For added security, we’ve provided the option of displaying a screen name instead of your real name. You may elect to use your real name as your screen name. Your screen name will be displayed on your “My World” page, on map info tags, with your comments, friend requests, and as a byline for your shared content. Screen names should not be offensive, vulgar, or obscene, nor should they use a real name of another person, company, or entity. Sharing Your Information Uncharted is very concerned about your personal privacy. We will never share, rent, or sell your e-mail address, physical address, or other information to a third party. If you engage in any illegal or prohibitive activity, we will comply with legal requirements and report that activity and any information legally required to the appropriate law enforcement or government agencies. E-mail Communications You must have an active e-mail address to be a member of Uncharted. Your e-mail address is never publicly displayed. We only use your e-mail to provide you with useful information and to help you keep in touch and connect with other explorers and our staff. You can manage what kind of e-mails you receive from us through your explorer profile user preferences. However, please understand that you will continue to receive e-mail notifications from the site when retrieving or changing your password, deleting your account, and when we notify you of legal requirements or updates to our policies. Uncharted Staff may also contact you personally to request permission to use your profile or shared content for promotional purposes in its online and print products, educational programs, and services, or for featuring content on the homepage. Regardless of their user preference settings, users will still receive notifications if they have signed up for specific products and services such as workshops, contest entries, other purchases, and any other inquiries. User Data We track user data that helps us recognize your browser and tells us how and when pages on our website are visited and how many people use our service. We do not use these analytics to collect information that can be directly tied to you personally. Some advertisements displayed on Uncharted may be selected based on textual information, tags, metadata, and mapping information that are associated with or displayed on the page that you are viewing, or due to a search term you entered. Location Information and Sharing Since Uncharted is about helping people find new places to explore, all content is marked and displayed to the public on maps. Currently, Uncharted uses Google Maps. Uncharted is not liable or responsible for any inaccurate mapping data displayed on Uncharted through Google’s mapping service. Uncharted reserves the right to change or discontinue its use of mapping services at any time without prior notice. While Uncharted gives users the option of providing a mailing address in order to send prizes, products, and other information, in the interest of your personal safety, we will never display your street address and zip code. User location information that is displayed on the “My World” page, maps, and map information windows includes your home city, state/province, and country. Children Under 18 Years of Age You have to be at least 14 years or older to be a member of Uncharted. If we learn that a user is under the age of 14, we will delete that information as soon as possible. Minors between the ages of 14 and 18 must ask and receive parental permission before signing up for Uncharted. Changes to this Privacy Policy Uncharted may revise or ammend this Privacy Policy, its Terms and Conditions of Use, and the Uncharted Community Guidelines at its own discretion and at any time without notice.
